Terms of Service

These terms are a draft pending legal review.

The sections below describe how Take works and what users agree to. They are factual, but they have not been reviewed by a lawyer. Do not take real user data or payments until this document has been legally reviewed.

What Take is

Take is a music collaboration tool operated by Dead Pixel Design. It lets producers share audio files (stems and rough mixes) and feedback with collaborators. Take is not a cloud DAW. It does not edit, mix, or modify your audio files.

Accounts

You need an account to use Take. You are responsible for keeping your login credentials secure. You must provide accurate information when creating an account. Do not share your API tokens — they grant access to your projects.

Your content

You retain ownership of all audio files, comments, and project data you upload to Take. By uploading content, you grant Take the limited rights needed to operate the service: storing your files, generating compressed playback versions, serving them to you and your collaborators, and including them on public wrap pages if you choose to publish one.

Do not upload content that you do not have the right to share. This includes copyrighted material you did not create unless you have permission.

Payment and subscriptions

Take offers a free tier and a paid tier ($12/month). The paid tier includes Reaper integration, voice memos, expanded storage (100GB), 12-month history, and public wrap pages. The project owner pays; collaborators on that project use paid features without a separate subscription.

Payments are processed through Stripe. You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months.

We reserve the right to change pricing with 30 days’ notice. Changes will not affect your current billing period.

Acceptable use

Do not use Take to:

  • Upload malware, viruses, or malicious code.
  • Share content that is illegal in your jurisdiction.
  • Abuse the service (excessive automated uploads, attempts to circumvent storage limits, scraping).
  • Impersonate others or misrepresent your affiliation with Take or Dead Pixel Design.

We reserve the right to suspend or terminate accounts that violate these terms.

Service availability

Take is hosted on Vercel and Supabase. We aim for high uptime but do not guarantee uninterrupted service. We are not liable for data loss caused by service outages, though we do maintain regular database backups.

Limitation of liability

To the fullest extent permitted by law, Dead Pixel Design is not liable for any indirect, incidental, or consequential damages arising from your use of Take. This includes, but is not limited to, loss of audio files, project data, or revenue.

Termination

You can delete your account at any time. We will delete your projects, audio files, and profile data from our database. We reserve the right to terminate accounts that violate these terms or remain inactive for an extended period.

Changes to these terms

We may update these terms as Take evolves. We will notify active users of material changes via email. Continued use after changes take effect constitutes acceptance.
